Board of State & Community Corrections -

A report of information and data submitted to the BSCC by all 58 jurisdictions by way of the 2016-2017 Fiscal Year. The report touches on various approaches California counties have taken to best use the allocation of Realignment funding to invest in holistic and evidence based approaches to evaluate programs to improve outcomes in reducing recidivism. Counties include Imperial County, Los Angeles County, San Francisco County, Riverside County, San Joaquin County, and Santa Clara County.

The California Board of State and Community Corrections (BSCC) is an independent statutory agency that provides leadership to the adult and juvenile criminal justice systems, expertise on Public Safety Realignment issues, a data and information clearinghouse, and technical assistance on a wide range of community corrections issues.

Report on the impact of Second Chance Act (SCA) programs and an evaluation of whether such programs reduce recidivism and increase employment. Study randomly assigned 966 adult offenders in 4 counties and 3 different states to re-entry program treatment or control groups with recidivism and employment measured at 18 and 30 months. Study found no reduction in recidivism rate for either group, but an increase in employment and earnings for those assigned to the treatment. Report suggests results could be improved with additional funding to counties.

The Office of Justice Programs provides federal leadership in developing the nation’s capacity to prevent and control crime, administer justice, and assist crime victims.

A scientific article intending to identify policies that optimize tradeoff between public safety and prison congestion taking place when prisons decide to implement split sentencing. Study uses a simulation model to track flow of inmates over time in Los Angeles County jail system using California Static Risk Assessment tool. Study results suggest split-sentencing for all low-level felons is key in managing tradeoff between public safety and jail congestion.

Article examining county jails of Los Angeles and Contra Costa to understand whether the Public Safety Act is effective or not. Contra Costa minimized the number of prisoners while Los Angeles reported an increase. Article suggests without the "stick" of litigation, prison downsizing is unlikely to be achieved in California.

Additionally, this report provides an outline on the reasons this method of alternatives to incarceration is effective. The authors highlight that intensive data collection on county implementation efforts such as supervision and targeted services can help the state identify the community-based strategies that produce the most promising outcome.

A research article intended to understand how AB 109 has been implemented on a local level using county level research based on interviews and literary research. Interviews were conducted with probation department officials from 4 different counties to gain insight on PRCS and to understand non-incarceration strategies. Literary research was limited to brief research of overcrowding at county jails. Results of this research recommends that California incentivizes faster trials, adjust arrest and sentencing practices, establishes centralized, statutory of county best practices, increase use of programs that reduce recidivism, provide transitional services to all inmates, and ensure adequate staffing.

University of Southern California’s Price School of Public Policy conducts research to promote innovative solutions to critical issues facing society today.

Author refers to Sundt et al (2016) in addressing crime rates’ connection to AB 109’s implementation and to the nation’s imprisonment rate. Author indicates that future research should focus on the degree that incarceration and crime will affect each other and how prisoner populations should be managed.

Author offers insight of design and use of split sentencing, RNR model, and evaluation of recidivism and incarceration rates in San Francisco County as a result of incorporating RNR assessment into split sentencing. Article expands on mechanisms intended to alleviate ambiguity of effects of AB 109 such as split sentencing and Section 1170(h) of the Penal Code. Provides discussion of California Rule 4.411.5 to stress value of risk assessment post-realignment. Author emphasizes importance of risk assessment in pursuit of changes in criminal corrections system.

An article investigating jail management by tracking flow of inmates in Los Angeles County Jails. Study uses a mathematical model of inmate flow and assesses 64 joint pretrial release and split sentencing policies and compare their performance to LA county policy in 2014. Study accredits effectiveness of split sentencing to split sentencing exposing offenders to less time under recidivism risk per saved jail day and to felony offenders comprising about 45% of LA County’s jail population in 2014.

A study examining effects of AB 109 on superior court judges' decision making in California. Data comes from a survey of 112 judges in California asking judges about sentencing choice between felony probation and new California Penal Code §1170(h) county jail sentences. Study highlights more than half of judges surveyed preferred an 1170(h) sentence. Results emphasize that California Legislation and judiciary should clarify relationship between felony probation and an 1170(h) sentence and formulate a consensus of how to use split sentencing.
